MOTOR VEHICLE ACCIDENTS
Accidents involving injuries
A person making a claim for personal injury arising out of a motor vehicle accident MUST:
- Notify the police immediately.
- Give a notice of claim to the compulsory third party insurer within 28 days from the date of seeing a solicitor.
OR
- If a solicitor has not been consulted, give a notice of claim to the compulsory third party insurer within nine months of the date of the accident or injury.
Vehicle damage
- You can claim for vehicle damage up to six years from the date of the accident.
- When lodging the claim for damage, you are required to get at least two written quotes from qualified repairers.
- You should then send a letter of demand to the other driver enclosing the copies of the quotes and demand payment within a fixed time.
- If the other party fails to respond, an action can be taken in the Magistrates Courts or where the amount is $7,500.00 or less, in the Small Claims Tribunal.
